Terms of Service
These terms are between Porto AI ("Porto", "we", "us") and the business that signs up for Porto ("you"). You accept them when you sign an order form or pay an invoice. Paddle sells Porto subscriptions as our reseller of record and handles payments and sales tax.
1. The service
Porto builds, hosts and maintains a custom AI intake for your website, along with a dashboard where your team sees conversations and briefs. What is included depends on the plan in your order form.
2. Setup and fees
The setup fee is paid up front and is not refundable once work has started. Monthly fees are billed in advance. Plans have a three month minimum term. Conversations above your plan are billed at the rate in your order form. We give 30 days notice before changing prices.
3. Cancelling
After the minimum term you can cancel at any time before your next billing date. You keep access until the end of the period you paid for, and you can export your data for 30 days after that.
4. Your responsibilities
You give us accurate information about your business, keep a privacy notice on your website that mentions Porto, use the service lawfully, and follow the Acceptable Use Policy.
5. AI output
The assistant can make mistakes. Fit scores and briefs are suggestions to help your team, and your team makes the decisions. The assistant does not give legal, medical or financial advice and is configured not to.
6. Your data
You own your content and the information your visitors share. We process it only to provide the service, as set out in the Data Processing Agreement.
7. Availability
We aim for 99.5% monthly uptime and give notice of planned maintenance. If we miss it in a month, you can ask for a credit of 10% of that month’s fee.
8. Liability
Neither party is liable for indirect or consequential losses. Our total liability under these terms is limited to the fees you paid in the 12 months before the claim.
9. Changes and governing law
We will email you 30 days before material changes to these terms. These terms are governed by the laws of El Salvador.
